Our Fixd Service Standard

At FIXD REPAIR our goal is to save you time and money on home services through flat rate pricing while providing you with the best service possible. Accordingly, at FIXD REPAIR we stand behind the work by the Service Professionals with the FIXD REPAIR Service Standard, and the FIXD REPAIR Limited Warranty. This agreement (the “Service Standard Terms”) set forth the benefits and eligibility requirements for the FIXD REPAIR Service Standard and Limited Warranty (where applicable).

Capitalized terms used but not defined herein have the meanings assigned to them in the FIXD REPAIR Consumer Terms ( www.fixdrepair.com/terms ). The FIXD REPAIR Service Standard gives you specific legal rights, and you may also have other rights which vary from state to state.

The Service Standard. If you are not satisfied with the performance of your Service Order, for any reason, and if you meet all the conditions and criteria described in these Service Standard Terms, please contact FIXD REPAIR in the method described below and FIXD REPAIR will either, in its sole discretion, seek to fix the problem, at our expense, or reimburse you for the amount you originally paid for the Service Order. Notwithstanding the foregoing, the maximum amount we will incur or pay you for a claim under the FIXD REPAIR Service Standard will not exceed $10,000.

Eligibility. To be eligible to pursue a claim under the FIXD REPAIR Service Standard, you must meet all of the following requirements:

  • FIXD REPAIR Account. You must have an Account with FIXD REPAIR and have purchased a Service Order. In addition to registering and creating an Account, you must be and remain in full compliance with these Service Standard Terms.
  • Your Relationships. Neither you, nor any member of your immediate family, nor any member of your household, may be affiliated with the FIXD REPAIR Service Professional who has provided you with services.
  • Performance of Service Order. All work done pursuant to a Service Order must be performed by a FIXD REPAIR Service Professional. In other words, if, in connection with a Service Order, you elect to hire additional worker(s) that are not approved FIXD REPAIR Service Professionals, doing so will render the FIXD REPAIR Service Standard null and void.
  • Alterations or Modifications. The FIXD REPAIR Service Standard is rendered null and void if you materially alter or modify any parts, equipment, service or work provided by the FIXD REPAIR Service Professional, except to the extent necessary to minimize damage to your home/premises resulting from any claim asserted under these Service Standard Terms.
  • Services Declined. If, at the time of the performance of the Service Order, recommendations were made by the Service Professional to address the problem identified in the Service Order or other problems that may have been discovered in the course of the performance of the Services (the “Recommended Services”) and you declined such recommendations, the FIXD REPAIR Service Standard does not apply to any problems that arise which would have been addressed by purchasing the Recommended Services.
  • Payment for Service Order. The FIXD REPAIR Service Standard only applies to Service Orders for which you have paid in full, and for which you have record of such payment. Furthermore, the FIXD REPAIR Service Standard is rendered null and void if you seek to stop payment for any Service Orders, such as disputing or otherwise contesting or refusing the related charge to your credit card.
  • 30-Day Limitation. A CLAIM UNDER THE FIXD REPAIR Service Standard MUST BE SUBMITTED WITHIN THIRTY (30) DAYS AFTER THE COMPLETION OF THE SERVICE ORDER AND IN ACCORDANCE WITH THE PROCESS DESCRIBED IN THESE SERVICE STANDARD TERMS. All information provided during the claim process must be accurate and complete.

FIXD REPAIR Limited Warranty

The FIXD REPAIR Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

The Limited Warranty.

Limited Warranty of Workmanship. EXCEPT AS SET FORTH BELOW, FIXD REPAIR PROVIDES A LIMITED WARRANTY AS TO THE WORKMANSHIP OF THE SERVICES FOR NINETY (90) DAYS FROM THE DATE OF COMPLETION. DURING THE WARRANTY PERIOD, FIXD REPAIR WILL ARRANGE FOR REPAIR AT NO CHARGE TO YOU OF ANY DEFECTS (AS DETERMINED BY A THIRD PARTY ASSESSMENT) DUE TO FAULTY WORKMANSHIP. THE FIXD REPAIR WARRANTY DOES NOT COVER (1) DAMAGE RELATED TO SUBSEQUENT ALTERATIONS, MISUSE, ABUSE, NEGLECT, IMPROPER CARE/CLEANING, OR PRE-EXISTING CONDITIONS OF THE COVERED ITEMS NOT MADE KNOWN TO THE SERVICE PROFESSIONAL AT THE TIME OF THE SERVICE ORDER; (2) DAMAGE RESULTING FROM FIRES, STORMS, ELECTRICAL MALFUNCTIONS, ACCIDENTS, FLOODS, SUB-GRADE MOISTURE CONDITIONS, OR ACTS OF GOD; (3) DAMAGE RELATED TO CUSTOMER’S OR HIS AGENTS’ FAILURE TO OBSERVE ANY INSTRUCTIONS OF THE MANUFACTURER’S REQUIREMENTS, INCLUDING SPECIFIC PRODUCT RECOMMENDATIONS; (4) ANY PRODUCT LOSS DUE TO REFRIGERATOR OR FREEZER PRODUCT FAILURES; (5) ANY ITEM FURNISHED BY THE CUSTOMER.

Limited Warranty of Merchandise. MERCHANDISE AND MATERIALS PROVIDED IN THE COURSE OF SERVICES ARE SUBJECT TO ONE OF THE FOLLOWING WARRANTIES DEPENDING ON APPLICABILITY:

  • MERCHANDISE AND MATERIALS PROVIDED BY THE SERVICE PROFESSIONAL WILL BE COVERED BY THE APPLICABLE MANUFACTURER’S WARRANTY, IF ANY; OR
  • IF A MANUFACTURER’S WARRANTY IS NOT APPLICABLE, THEN THE MERCHANDISE AND MATERIALS WILL BE COVERED BY THE FIXD REPAIR LIMITED WARRANTY FOR A PERIOD OF UP TO NINETY (90) DAYS FROM THE DATE OF COMPLETION OF THE SERVICE ORDER OR SUCH OTHER PERIOD AS MAY BE APPLICABLE AS SET FORTH BELOW. IF A MANUFACTURER’S WARRANTY IS NOT APPLICABLE, DURING THE WARRANTY PERIOD, FIXD REPAIR WILL, AT ITS SOLE DISCRETION AND EXPENSE, EITHER ARRANGE FOR REPAIR OR REPLACEMENT OF ANY DEFECTIVE MERCHANDISE OR MATERIALS. THE FIXD REPAIR WARRANTY DOES NOT COVER (1) DAMAGE RELATED TO SUBSEQUENT ALTERATIONS, MISUSE, ABUSE, NEGLECT, IMPROPER CARE/CLEANING, OR PRE-EXISTING CONDITIONS OF THE COVERED ITEMS NOT MADE KNOWN TO THE SERVICE PROFESSIONAL AT THE TIME OF THE SERVICE ORDER; (2) DAMAGE RESULTING FROM FIRES, STORMS, ELECTRICAL MALFUNCTIONS, ACCIDENTS, FLOODS, SUB-GRADE MOISTURE CONDITIONS, OR ACTS OF GOD; (3) DAMAGE RELATED TO CUSTOMER’S OR CUSTOMER’S AGENT’S FAILURE TO OBSERVE ANY INSTRUCTIONS OF THE MANUFACTURER’S REQUIREMENTS, INCLUDING SPECIFIC PRODUCT RECOMMENDATIONS; (4) ANY PRODUCT LOSS DUE TO REFRIGERATOR OR FREEZER PRODUCT FAILURES; (5) ANY ITEM FURNISHED BY THE CUSTOMER.

  • Performance of Service Order. All work done pursuant to a Service Order must be performed by a FIXD REPAIR Service Professional. In other words, if, in connection with a Service Order, you elect to hire additional worker(s) that are not approved FIXD REPAIR Service Professionals, doing so will render the FIXD REPAIR Limited Warranty null and void.
  • Alterations or Modifications. The FIXD REPAIR Limited Warranty is rendered null and void if you materially alter or modify any parts, equipment, service or work provided by the FIXD REPAIR Service Professional, except to the extent necessary to minimize damage to your home/premises resulting from any claim asserted under these Service Standard Terms.
  • Services Declined. While the rejection by you of Recommended Services does not invalidate the FIXD REPAIR Limited Warranty, if FIXD REPAIR determines, in its sole discretion, that the most expedient manner to resolve the identified problem(s) is to complete the Recommended Services, you understand and agree that if you decline the Recommended Services, then the FIXD REPAIR Limited Warranty will be rendered null and void for the work done under the Service Order.
  • Payment for Service Order. The FIXD REPAIR Limited Warranty only applies to Service Orders for which you have paid in full. Furthermore, the FIXD REPAIR Limited Warranty is rendered null and void if you seek to stop payment for any Service Orders, such as disputing or otherwise contesting or refusing the related charge to your credit card.
  • One (1) Limitation. A CLAIM UNDER THE FIXD REPAIR LIMITED WARRANTY MUST BE SUBMITTED WITHIN THIRTY (30) DAYS (OR SUCH OTHER PERIOD AS MAY BE APPLICABLE AS SET FORTH BELOW) AFTER THE COMPLETION OF THE SERVICE ORDER AND IN ACCORDANCE WITH THE PROCESS DESCRIBED IN THESE SERVICE STANDARD TERMS. All information provided during the claim process must be accurate and complete.

Filing your FIXD Protection Plan Claim

Filing Your Claim. If a problem develops during the warranty period, you may file a claim by emailing us at support@fixdrepair.com and providing all of the requested information. If you do not have access to a computer or if the account creation portion of the website is not available, please call (844) 349-3669 to submit your claim via telephone. As part of the claim process, you will be asked to provide the following information: your name, address, telephone number, user ID or account number, a complete description of the Services contracted for and performed, and the problem, and such other information or documentation (including photos) as we may reasonably deem necessary to assess your claim. You represent and warrant that all information included on your claim form or otherwise provided to us and all documentation you submit relating to your claim will be complete, accurate and free of material omissions. We will determine if the evidence you provide is reasonable and sufficient, in our sole discretion, and if so, we will process your claim in accordance with these Service Standard Terms. We reserve the right to request additional information relating to your claim at any time, and your rights under the Service Standard will be subject to your providing us with all requested information. FIXD REPAIR will work as expeditiously as possible to address your claim, but you acknowledge that it may take six weeks or more from the time you submit your claim and all required documentation to complete resolution of your claim. However, we will have no liability for any failure to resolve or make payment for your claim within this projected time period. In addition, if you fix or repair (or hire another service provider to fix or repair) any problem that resulted in the filing of your original claim with us prior to us processing and resolving your claim, your claim will be automatically disqualified and you will be ineligible to receive any payment from us for that claim, unless such fix or repair was necessitated by exigent circumstances (such as loss of electricity or water, or water damage), as determined by FIXD REPAIR in its sole discretion.

  • Validation of Claim. Upon receipt of your claim and documentation, we will evaluate your claim to determine if your claim is valid and, if we so determine, we will determine the appropriate resolution to your claim. You agree that we may disclose to the FIXD REPAIR Service Professional the information you provide relating to your claim and the services provided to you. We reserve the right to determine in our sole discretion that your claim is not valid. We will notify you of our determination by sending an email to your registered email address.
  • Resolution of Claim. If we determine that your claim has merit, we can, in our sole discretion, attempt to remedy the problem, at our expense, by sending up to two (2) Service Professionals to you to remedy the issue, or we can elect to pay you the amount originally paid by you for the Service Order. Notwithstanding the foregoing, the maximum amount we will incur or pay you for a claim under the FIXD REPAIR Service Standard will not exceed $10,000 for each Service Order. If we decide to remedy the problem or seek alternative estimates for repair of the problem, you agree that you will cooperate with such efforts, including providing access to the site/premises of the Service Order, meeting with the other FIXD REPAIR Service Professionals identified by FIXD REPAIR to correct the identified problem(s), and providing complete and accurate information to any necessary third party about the service and your attempts to resolve the claim. We will make payments, if applicable, by paying the Service Professional directly to remedy the problem, by mailing you a check at your address provided in your registration, or by refunding your credit card.

Miscellaneous Terms

  • Changes to the Terms. We may change these Service Standard Terms at any time. We will notify you of changes to these Service Standard Terms by posting the revised Service Standard Terms on this website. You should check the date of the Service Standard Terms appearing at the beginning of the Service Standard Terms and review any changes since the last version. Updated versions of the Service Standard Terms will never apply retroactively and the updated Terms will give the exact date they go into effect. Revised Service Standard Terms will be effective when posted. The Service Standard Terms in effect on the date of your most recent Service Order, however, will apply to any claim you make with respect to the services provided by FIXD REPAIR.

  • Termination. We may terminate the FIXD REPAIR Service Standard, in whole or in part, at any time for any reason in our sole discretion. Any such termination will not affect the availability of the FIXD REPAIR Service Standard for any Service Orders made prior to such termination, but will be effective going forward as of the time the FIXD REPAIR Service Standard was terminated.
  • Dispute Resolution/Class Action Waiver. For any disputes arising out of or related to the Service Standard or Limited Warranty, please see the Dispute Resolution/Arbitration provision of the FIXD REPAIR Terms of Service ( www.fixdrepair.com/terms), which shall govern such disputes.
  • Severability; Interpretation. If a court in any final, non-appealable proceeding of a court of competent jurisdiction holds any provision of these FIXD REPAIR Service Standard Terms or its application to any person or circumstance invalid, illegal or unenforceable, the remainder of these Service Standard Terms, shall not be affected, and shall be valid, legal and enforceable to the fullest extent permitted by law. When used in these FIXD REPAIR Service Standard Terms, the term “including” shall be deemed to be followed by the words “without limitation.”
  • Entire Agreement. These Service Standard Terms (as well as the Fixd Repair Terms of Services) constitute the entire and only agreement between FIXD REPAIR and each user of this Site and/or the Services with respect to the FIXD REPAIR Service Standard and supersedes any and all prior or contemporaneous agreements, representations, warranties and understandings, written or oral, with respect to the subject matter of these Service Standard Terms.

Exceptions to the FIXD REPAIR Limited Warranty

Below are exceptions to the FIXD REPAIR Limited Warranty obligation as explained in the FIXD REPAIR Service Standard. If there is a conflict between the warranty obligations below and those set forth in the Terms and Conditions, the requirements below shall control.

Plumbing

Drain Clearing/Waste Stoppages/Filter Cleaning: If within thirty (30) days after the completion of any plumbing services involving drain clearing, waste stoppages or filter cleanings, the stoppage re-emerges, FIXD REPAIR shall clear such stoppage.

HVAC

Thermostat Batteries: If within thirty (30) days after the completion of any HVAC Service Order involving replacing thermostat batteries, the batteries are no longer working properly, FIXD REPAIR shall either repair or replace the battery.

Refrigerant Replacement Without Leak Search: If within thirty (30) days after the completion of any HVAC Service Order involving refrigerant replacement, the refrigerant leak is persisting, FIXD REPAIR shall fix such leak, provided that FIXD REPAIR was permitted to perform a diagnostic leak search prior to initially replacing the refrigerant.

Electrical

Electrical Panel Changes & Upgrades: If within three (3) years of Service Order involving electrical panel changes or upgrades to electrical panels, the electrical panel ceases to work, FIXD REPAIR shall remedy any such defect to the electrical panel.

Locksmith

Parts Warranty: FIXD REPAIR warrants all replacement parts and repairs for ninety (90) days from the date of the Service Order.

Garage Door

Parts Warranty: FIXD REPAIR warrants all replacement parts and repairs for ninety (90) days from the date of the Service Order.

Appliance Repair

Parts Warranty: FIXD REPAIR warrants all replacement parts and repairs for ninety (90) days from the date of the Service Order.

Pool Repair & Cleaning

Drain Clearing/Waste Stoppages/Filter Cleanings: If within thirty (30) days after the completion of any Pool Maintenance Service Order involving drain clearing, waste stoppages, or filter cleanings, the stoppage re-emerges, FIXD REPAIR shall clear such stoppage.

Damage from Cleaning Supplies: FIXD REPAIR shall remedy any damage resulting solely and directly from pool cleaning supplies, which shall appear within thirty (30) days from the final completion of the Service Order.
